Vicar General of the Diocese

Vicar General is a priest nominated by the diocesan bishop who shares in the executive power of the diocesan bishop including the general delegated power of the Holy See unless it is not delegated only to the person of the bishop, within the limits set by law. He has ordinary executive power.

Chancellor

Chancellor's Principal function is to take care of the acts of the Curia. They have to be gathered, arranged and safeguarded in the archive of the curia. He is the ex-offico notaries and secretaries of the Curia.

Episcopal Vicar

Episcopal vicar is a priest appointed by the diocesan bishop similar to Vicar General with ordinary vicarious power of governance of a particular territory in the diocese or a certain type of affairs or over the faithful of a specific rite, who assist the bishop in the effective governance of the diocese.

College of Consultors

College of Consultors is a group of priests, numbering between six or twelve, freely chosen by the diocesan bishop from the Presbyteral council or senate of priests to assist him in the pastoral governance of the diocese.

Senate of Priests

Senate of priests of the Presbyteral Council (General Body of the diocesan Priests includes all the priests) is a representative group of priests chosen from the presbyterium of the diocese to serve as a senate of the bishop in order to assist him according to the law in the governance of the diocese and in the pastoral welfare of the diocese and is convoked and presided over by the diocesan bishop. This is a consultative body of the diocese. It is composed of ex-officio members; members chosen by the bishop and at least a half of it is directly elected by the priests. Duration of the council is five years.

The election to the Senate of Priests held at the Bishop's House on March 21, 2005 and that of the by-election held at the Animation centre on June 7, 2005 and constituted as per Can. 451/ §1, for a period of three years w.e.f. 10 June 2005.

Diocesan Pastoral Council

Diocesan Pastoral Council , is a representative body composed of laity in full communion with the Church, members of the institutes of Consecrated Life and Societies of Apostolic Life and priests of the diocese reflecting various foranes, social conditions and apostolate of the diocese, appointed for a definite period of time to study pastoral issues and to draw practical conclusions that would help the bishop in the governance of the diocese. It is convoked and presided by the Diocesan Bishop and has only consultative vote.

Finance Council & Procurator

Finance Council and the financial administrator are the bodies entrusted with the management of temporal goods of the diocese. The finance council is composed of at least three members of the faithful presided over by the diocesan bishop or his delegate for a term of five years, which could be extended to further terms of five years. They have to prepare the annual budget of the diocese under the direction of the Bishop and to account at the end of the year for income and expenditure. Financial administrator is appointed also for a term of five years, which could be extended to further terms. Under the authority of the Bishop he is to administer the goods of the diocese in accordance with the plan of the finance committee and to make payments from diocesan funds, which the Bishop or his delegates have lawfully authorized.

Foranes and Forane Vicars

Forane Vicar is a priest appointed by the diocesan bishop, who is placed in charge of the vicariate Forane and has the responsibility of promoting pastoral coordination and cooperation, keep disciplinary vigilance to ensure that the legal and liturgical prescriptions are observed, assistance and service for the benefit of the clergy of the vicariate Forane. He also has the additional responsibility of visiting the parishes of his territory in accordance with the arrangement made by the diocesan Bishop.

There are six vicariate foranes in the diocese.

Diocesan Tribunal

Ecclesiastical Tribunals : All the Tribunals of the Church are erected according to canons 1404-1731, except the norms of the Tribunals of the Apostolic See. The objects of the trial are to pursue or vindicate the rights of physical or juridical persons, or to declare juridical facts; or to impose or declare penalties in regard to offences. There is also administrative process in the Church to pursue justice in the system of judicial protection in the Church (can 1400).

Usually, most of the cases that come to the ecclesiastical Tribunals are to declare juridical fact of validity or invalidity of the sacrament of marriage or at times vindicate or pursue the right of a partner in marriage against the other (eg. Separation of bed and board of the spouses)

Most of the cases that are dealt in Quilon Diocesan Tribunal are for examining whether the marriage in question was valid or invalid.

Quilon Diocesan Tribunal : The Diocesan Tribunal functions adjacent to the Chapel of the Bishop's House on Wednesdays to Fridays from 10.00am to 12.00am . This tribunal judges in the first Instances the cases of the diocese of Quilon and it is the second instance (appeal) Tribunal to the Latin Archdiocese of Trivandrum.

The diocesan Bishop exercises his judicial power through the Judicial Vicar who is appointed with ordinary power to judge. He is distinct from the Vicar General. is the head of the diocesan tribunal. The judicial vicar cannot judge the cases the bishop reserves to himself.

Modus operandi of the Tribunal : The petitioner drafts the petition regarding the matter of the case and the parish priest endorses the petition and forwards to the tribunal. Before which the parish priest is duty bound to try his level best to reconcile the parties in case. Any person baptized or not can plead before the tribunal. A person lawfully brought to trial must respond. The petitioner or the respondent if necessary can appoint procurator or ecclesiastical advocate. Minors or those who lack use of reason can stand before the court only through parents, guardians or curators. The petition is handed over to the judicial vicar, a provisory number is given to the case and he or his delegate studies the petition and makes a preliminary interview to understand the standing of the case. The parties are called to see whether reconciliation is yet possible. However, if the parties want the trial, the judicial vicar constitutes the Tribunal of the first Instance and the parties are summoned and formulation of the doubt is made. The collection of evidences and depositions are taken, when the judge is satisfied with the proof, he shall conclude the case for discussion, after summoning the parties again see the case. Then the judgment is drafted and the judgment of the first instance is issued and parties notified. They could appeal against it within 15 days of the notification of the judgment to the judge who delivered the sentence to send the appeal together with the sentence of first Instance to the Tribunal of second Instance at Tribunal of the Latin Archdiocese of Trivandrum. The sentence of the second instance may or may not confirm the sentence of the first instance. The sentence can be executed if it is confirmed by the second instance. The third instance is the Tribunal of the Rota Romana, in Rome . Usually the ratified or otherwise the judgment of the second Instance is send to the first instance tribunal. The Judicial vicar drafts a decree on its effect and sends it to the proper parish priest and the parties. TOP
